Who is included in the Settlement? The Settlement includes individuals (also called Class Members) who were forced to remove a religious head covering for a photograph while in custody of the NewYork City Police Department from March 16, 2014 to August 23, 2021 . How can I get a payment? To receive payment, you need to submit a claim form online or by mail postmarked by September 26, 2024 . If your claim is complete, you will get between $7,824 and $13,125 for each time your religious head covering was removed. What are my rights? Even if you do nothing, if you are a Class Member, you will be bound by the Court’s decisions about the Settlement. If you do not want to be part of the Settlement and, instead, want to keep your right to sue the City of NewYork, your request to exclude yourself from the Settlement must be received by September 26, 2024. If you want to stay in the Settlement but want to object to its terms, your objection must be received by September 26, 2024. The Court will hold a hearing on October 29, 2024 at 1:00 p.m. to consider whether to approve the Settlement, a request for attorneys’ fees and costs, and special service payments of $35,000 to each of the class representatives and $3,500 to $7,000 to each class member who was deposed as part of absent class discovery. Attorneys’ fees will be the amount remaining after administrative costs and special service payments are deducted from $4,375,000. You or your own lawyer may appear and speak at the hearing at your own expense.
